1. Scope of Agreement
These Terms apply to all services provided by Clear It Waste Management Ltd ("we", "us", "our") including waste collection, removal, loading, transport, recycling, and disposal services.
By booking or accepting a quotation, you ("the Customer") agree to be bound by these Terms.
2. Quotes & Bookings
All quotations are based on the information provided by the Customer at the time of enquiry, including but not limited to waste type, volume, access conditions, and location.
Quotes are estimates only and are not binding until confirmed on-site or by telephone prior to commencement of works. Unless otherwise stated, written quotations are valid for 30 days from the date of issue.
We reserve the right to amend pricing where:
- Waste volume differs from the original description
- Access conditions are materially different
- Additional labour, time, or disposal costs are required
- Undisclosed or restricted waste is identified
The website does not process payments. Payment terms are confirmed before or upon completion of service unless otherwise agreed in writing.
2a. VAT
Prices quoted are inclusive of VAT where VAT applies. Where the Company is, or becomes, registered for VAT, VAT will be charged at the prevailing rate and shown separately on invoices. Our VAT registration number (where applicable) will be displayed on invoices and on this website.
2b. Consumer Cancellation Rights (Distance & Off-Premises Contracts)
If you are a consumer (not a business) and you book our services online, by telephone, or anywhere away from our business premises, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the contract within 14 calendar days of placing the order, without giving any reason.
To cancel, please email info@clearitwastemanagement.co.uk or call 01702 579 957 before the 14-day period ends. A model cancellation form is available on request.
Important: If you ask us to begin work during the 14-day cancellation period, you agree that:
- If the service is fully performed within the 14-day period, you lose the right to cancel.
- If you cancel after work has started, you must pay a reasonable amount for the work already carried out, calculated in proportion to the full price of the contract.
3. Scope of Service (What's Included)
Unless otherwise stated, all quotations include:
- Labour for loading waste
- Manual handling and clearance
- Transport in licensed waste vehicles
- Sweep up of cleared areas (reasonable standard only)
- Licensed disposal at authorised facilities
- Duty of Care Waste Transfer Note (WTN) in accordance with UK law
We aim to recycle up to 90% of collected waste, depending on waste stream and facility capability.
4. Excluded & Hazardous Waste
The following are strictly excluded unless explicitly agreed in writing prior to booking:
- Asbestos (any form)
- Clinical or medical waste
- Chemicals, solvents, oils, fuels
- Gas bottles or pressurised containers
- Radioactive or toxic materials
- Explosives or controlled substances
- Any waste classified as hazardous under UK regulations
If such materials are discovered on site, we reserve the right to:
- Stop work immediately
- Revise the quotation
- Charge for wasted attendance
- Report where legally required
5. Customer Responsibilities
The Customer confirms and warrants that:
- They are the legal owner or authorised disposer of the waste
- All waste has been fully disclosed prior to booking
- The site is safe and accessible for our operatives and vehicles
- No illegal, hazardous, or undeclared materials are present
The Customer remains legally responsible for the waste until it is collected and processed.
6. Access & Site Safety
The Customer must ensure:
- Safe and unobstructed access to the waste
- Suitable parking and loading conditions
- Adequate lighting where required
- No risk to health and safety of staff or third parties
Where access is restricted, unsafe, or significantly different from the description provided, we may:
- Pause or refuse work
- Recalculate the price on-site
- Charge for delay or wasted attendance
7. Cancellations & Failed Attendance
You may cancel or reschedule a booking with reasonable notice.
Where cancellation occurs after dispatch of a team or vehicle, or where access is not provided upon arrival, a call out or wasted journey fee may apply.
We reserve the right to charge for time, labour, fuel, and operational costs incurred.
8. Payment Terms
Payment is due immediately upon completion of services unless otherwise agreed in writing.
We reserve the right to withhold documentation (including Waste Transfer Notes) until payment is received in full.
Late or non-payment may result in:
- Statutory interest under the Late Payment of Commercial Debts Act 1998
- Recovery action and additional administrative costs
9. Liability & Insurance
We operate with appropriate public liability and waste carrier insurance provided by Accelerant Insurance UK Ltd.
We are responsible only for direct losses caused by our proven negligence.
To the fullest extent permitted by law:
- Liability is limited to the value of the job or insured cover applicable to that service
- We are not liable for indirect, consequential, or economic losses
- We are not liable for pre existing property damage or undisclosed hazards
Enhanced insurance coverage may be available for higher risk or commercial projects upon request.
10. Waste Transfer & Legal Compliance
We operate under Environment Agency registration (CBDU631149) as a licensed Upper Tier Waste Carrier.
All waste is transported only to licensed transfer stations or authorised disposal facilities.
Duty of Care documentation will be provided in accordance with UK waste legislation where applicable.
11. Ownership & Transfer of Waste
Ownership of waste transfers to Clear It Waste Management Ltd at the point of collection, provided payment terms are met.
Risk transfers upon loading and removal from site.
12. Right to Refuse Service
We reserve the right to refuse, suspend, or terminate services where:
- Safety is compromised
- Waste is misdescribed or illegal
- Terms are breached
- Staff are subjected to abuse, threats, or unsafe conditions
13. Data Protection
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Full details are set out in our Privacy Policy.
14. Website Use
The website is provided for general information only. We do not guarantee that all information is current or error free. Reliance on website content is at your own risk.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
